Is it possible to work in India as a European?

Yes, you can. We would like to bring Indian staff to Europe. What do we need to arrange?

If you decide to hire staff from India, there are two options. Bring them to Europe or have them work together remotely. We usually advise to hire your Indian staff in India and let them work together with your office in Europe from there. Alternatively, you can bring your Indian staff to the Netherlands for a work visit from time to time to train them or integrate them into your team.

We would like to employ staff, do we have to set up our own company? Or are there other possibilities, such as payrolling?

To employ staff in India, you need to have your own entity in India. However, it is questionable whether this is the smartest solution as starting your own entity in India is a time-consuming process. Setting up your own entity, for example, makes sense when you:

1) you expect to recruit a lot of employees,
2) your activities in India are an important part of your long-term strategy,
3) you want to retain your employees in the long term.

In many cases, however, it is advisable to first use the services of an Indian payroll. IndiaConnected works with reliable payroll partners who offer these services to foreign parties.

What do I need to consider while drafting an employment contract in India?

Employees are well protected in India, as they are in the Netherlands. Most guidelines are recognisable from European legislation. Every employee has the right to an employment contract. Legislation and taxes can differ per state.

Apart from salary costs, what additional costs do I incur when I hire someone in India?
In
India, during salary negotiations, people always talk about CTC (Cost-to-Company) - the total cost of employment from the employer's point of view - and Take Home - the amount that the employees actually get to take home at the end of the month. The exact CTC depends on 1) the state of the employee (some taxes differ from state to state) and 2) the employee's personal situation and preferences regarding the various allowances. Usually, the salary structure is discussed in detail per individual in order to find the best possible solution for the employee in the calculation of the CTC and the Take-Home Salary.
